The Minister of the Environment, Gian Luca Galletti, issued the decree laying down Guidelines for the EIA screening of projects falling within the competence of the Regions and Autonomous Provinces provided for in Article 15 of Decree 91/2014.
The adoption of the decree will enable Italy to overcome the objections made by the European Commission as part of the infringement procedure 2009/2086, started for non-compliance of the national legislation with EIA Directive.
The Guidelines provide for criteria for the EIA screening, regulated by article 20 of Legislative Decree 152/2006, of projects listed in Annex IV to Part Two of the Legislative Decree 152/2006 as amended in order to ensure a uniform and correct implementation throughout the Italian territory of the provisions of EIA directive.
The Guidelines integrate technical-dimensional and location criteria used for determining the thresholds already established in Annex IV to Part Two of the Legislative Decree 152/2006 for the different project categories, by identifying additional criteria contained in Annex V to Part Two of the Environmental Code, relevant to identify projects to be subject to EIA Screening.
Following a [...]complex and long approval process, the decree has been issued in agreement with the Ministry of Infrastructure and Transport and the State-Regions Conference and having received the favorable opinions of the competent parliamentary Committees.
The decree will enter into force fifteen days after its publication on the Official Journal of the Italian Republic.
