Every year the Ministry of the Environment issues about 70 EIA decisions (EIA and EIA Screening). The prescriptive framework attached to each EIA decision contains an average of 25-30 requirements concerning specific aspects of the environmental factors, of the design and management aspects, of the monitoring, mitigation and compensation measures.

Based on the experience gained in recent years, a number of difficulties have been recognized both by the developers in the implementation of the requirements and by the bodies responsible for the verification of the requirements’ compliance. The main causes are related to the unclear and ineffective wording of the requirement in terms of procedures and timing for its implementation, and to the great number of requirements and of the parties involved. These problems often involve requests for clarification and the implementation of further proceedings with consequent lengthening of ordinary timing required by the issuance of the final decision, leading in some cases to the impossibility to proceed with the implementation and/or verification of the compliance of the requirement itself.

In order to help overcoming these problems, the Minister of the Environment, Land and Sea, in agreement with the Minister of Cultural Heritage and Activities and Tourism, has issued a decree concerning the “Guidelines for the preparation of prescriptive frameworks attached to EIA decisions under state jurisdiction” which will come into force on the day following the date of publication in the Official Journal of the Italian Republic.
